Takimin Publik për Koncept Dokumentin për Fushën e Kompenzimit të Viktimave të Krimit /Public Meeting on Concept Paper on the Field of Compensation for Crime Victims.

18 mars 2019, Hotel Emerald, Prishtinë.  Ministri i Drejtësisë, zt. Abelard Tahiri, theksoi se që nga mandati i tij si Ministër i Drejtësisë është përpjekur ta fuqizoj perspektivën e frymës së ligjeve, jo vetëm si norma që ndalojnë praktika të caktuara por edhe si norma që krijojnë mundësi të reja, nga të cilat qytetari ynë do ushtroj të drejtat dhe liritë e tij. Ai gjithashtu tha që ka propozuar një qasje të re, e cila mundëson trajtim të dinjitetshëm ndaj viktimave të krimit, duke iu garantuar atyre të drejta në pajtim me standardet më të avancuara ndërkombëtare.Një qasje e tillë viktimave ju është ofruar përmes Projekt Kodit të Procedurës Penale të cilin e kam dërguar për shqyrtim dhe miratim në Kuvend. Zt.Tahiri gjithashtu tha se Projekt-Kodi të cilin e kemisponsorizuar dhe e kemi dërguar në Kuvend, jam i bindur se do arrijë objektiva të mëdha në luftimin e krimit të organizuar dhe korrupsionit, por në anën tjetër do t’i garantoj qytetarit të Republikës sonë një qasje të re për materializimin e të drejtave të tij.

Znj. Lana Owens Morton-përfaqësuese nga Ambasada e SHBA në Prishtinë, foli rreth rëndësisë së ndryshimit te këtij ligji,  pasi që sipas saj ligji ekzistues si i tillë nuk mund te jetë i mirë, për shkak të disa kufizimeve që janë konstatuar gjatë implementimit të Ligjit aktual, ky fakt tregon edhe me numrinevogël të kompensimeve. Prandaj znj. Morton konsideroi që ky ligj mund të jetë më i mirë dhe do të mund të  kishim një numër më të madh të përfituesve, edhe pse uroj të mos kemi viktima të dhunës.

Znj. Nesrin Lushta (Kryetare e Komisionit për Kompenzimin e Viktimave të Krimit) – theksoi se ligji për kompensimin e viktimave të krimit është miratuar me 28.05.2015, emërimi i Komisionit për kompensim është bërë në vitin 2016, ndërsa sigurimi i buxhetit është bërë në vitin 2017, ashtu që komisioni është funksionalizuar në qershor të vitit 2017, atëherë ka filluar me punën dhe me pranimin e kërkesave të para për kompensim, pasi që paraprakisht është përpiluar rregullorja për punën e brendshme të saj dhe janë bërë përgatitjet tjera të nevojshme.

Zt. Basri Kastrati (Prokuroria e Shtetit)– theksoi se është e rëndësishme që të gjithë kanë obligim që ti informojnë viktimat e krimit rreth mundësisë së kompensimit. Duke filluar nga Policia, Prokuroria dhe Gjykatat, Qendrat Sociale dhe të gjitha ato që lidhen direkt ose indirekt me viktimat e krimit. Ai gjithashtu përmendi shqetësimin se numri i veprave penale që duhet të kompensohen është duke u rritur  dhe se procedurat duhet te thjeshtësohen në mënyrë që të gjitha rastet e dhunës në familje duhet të kompensohen në forma më të lehta.

The Minister of Justice, Abelard Tahiri, stressed that since his term as Minister of Justice has tried to strengthen the spirit of the law, not only as norms that prohibit certain practices but also as norms that create new opportunities from which our citizen will exercise his rights and freedoms. He also said that he proposed a new approach that provides dignified treatment to crime victims, guaranteeing them rights in accordance with the most advanced international standards. Such access to victims has been provided to you through the Draft Code of Procedure Criminal I sent for review and approval to the Assembly. Mr. Tahiri also said that the draft code that we have conspired and sent to the Assembly, I am convinced that it will achieve great objectives in the fight against organized crime and corruption, but on the other hand, will guarantee the citizen of the Republic ours a new approach to materializing his rights.

Mrs. Lana Owens Morton, the representative from the US Embassy in Pristina, spoke about the importance of changing this law, as according to her, the existing law as such cannot be good due to some limitations that have been observed during the implementation of the current Law , this fact also shows the number of compensations. Therefore Mrs. Morton considered that this law could be better and we could have a greater number of beneficiaries, although I wish we did not have victims of violence.

Mrs. Nesrin Lushta (Chair of the Commission for Compensation for Crime Victims) – emphasized that the Law on Compensation for Victims of Crime was approved on 28.05.2015, the Appointment of the Compensation Commission was made in 2016, while the budget insurance was made in 2017 , so that the commission was functionalized in June 2017, then it started with the work and with the receipt of the first claims for compensation, as it had previously been drafted a regulation for its internal work and other necessary preparations were made.

For this reason, we are not here today to talk about the content of this law, but to discuss the challenges it has faced in order to overcome, to enable as many people as are victims of a crime to realize compensation and in this regard make changes to the law.

Mr. Basri Kastrati (State Prosecution) – stressed that it is important that everyone has an obligation to inform the victims of the crime about the possibility of compensation. Starting with the Police, Prosecution and Courts, Social Centers and all that are directly or indirectly related to crime victims. He also mentioned the concern that the number of criminal offenses to be compensated is increasing and that the procedures should be simplified so that all domestic violence cases should be compensated in lighter forms.
