Raporti hulumtues ”Qasja në Drejtësi për Viktimat e Dhunës në Bazë Gjinore në Kosovë”

Në kuadër të 16 Ditëve të Aktivizmit, me 3 dhjetor 2018 , në Bibliotekën Kombëtare në Prishtinë, Instituti Kosovar për Kërkime dhe Zhvillime të Politikave (KIPRED), Grupit për Studime Juridike dhe Politike (GLPS) dhe Qendra për Art dhe Komunitet Artpolis, publikuan raportin hulumtues Qasja në Drejtësi për Viktimat e Dhunës në Bazë Gjinore në Kosovë: Përfundimi i mosndëshkimit për Autorët e krimeve, ku morën pjesë përfaqësuesit kryesorë të institucioneve gjyqësore dhe jo-gjyqësore për të drejtat e njeriut në Kosovë. Media gjithashtu është e ftuar të marre pjesë në eventin lansues.Raporti analizon qasjen në proceset e drejtësisë për viktimat e dhunës në bazë gjinore, duke përfshirë dhunën në familje, dhunën seksuale, sulmet dhe ngacmimet seksuale, si dhe krimet e dhunshme kundër komunitetit LGBT. Raporti analizon ligjet dhe politikat ekzistuese, si dhe zbatimin praktik të tyre. Analiza kryhet duke iu referuar kërkesave të standardeve ndërkombëtare të të drejtave të njeriut, sidomos Konventës së Këshillit të Evropës për Parandalimin dhe Luftimin e Dhunës ndaj Grave dhe Dhunës në Familje (Konventa e Stambollit). Raporti konkretisht identifikon mangësitë në kuadrin ligjor aktual si dhe zbatimin praktik të tij. Ilustron vështirësitë e rënda ligjore dhe institucionale me të cilat ballafaqohen viktimat e dhunës me bazë gjinore gjatë përpjekjes për të kërkuar drejtësi. Raporti gjithashtu ofron rekomandime konkrete.

 

Research report Access to Justice for Victims of Gender-Based Violence in Kosovo:

Within the 16 Days of Activism, on December 3, 2018 at the National Library in Pristina, the Kosovo Institute for Policy Research and Development (KIPRED), the Group for Legal and Political Studies (GLPS) and the Center for Art and Community Artpolis, published the research report Access to Justice for Victims of Gender-Based Violence in Kosovo: Completion of Impunity for Criminals, attended by key representatives of judicial and non-judicial institutions for human rights in Kosovo. The media are also invited to participate in the launch event. The report analyzes access to justice processes for victims of gender-based violence, including domestic violence, sexual assault, sexual assaults and harassment, as well as violent crimes against the LGBT community. The report analyzes existing laws and policies, as well as their practical implementation. The analysis is conducted with reference to the requirements of international human rights standards, in particular the Council of Europe Convention for the Prevention and Combating Violence against Women and Domestic Violence (Istanbul Convention). The report specifically identifies shortcomings in the current legal framework and its practical implementation. It illustrates the serious legal and institutional difficulties faced by victims of gender-based violence in trying to seek justice. The report also offers concrete recommendations.
