The Police Administration in Prijepolje for a year of implementation of the Law on the Suppression of Domestic Violence pronounced 338 emergency measures – Policijska uprava u Prijepolju za godinu dana primene Zakona o suzbijanju nasilja u porodici izrekla 338 hitnih mera zabrane kontakta i udaljenja iz stana
June 19th, 2018: Since the beginning of the implementation of the Law on the Suppression of Domestic Violence, has passed more than a year, and during this period, 94 cases were registered in the Primary Public Prosecutor’s Office in Prijepolje, of which in 90 cases there was violence against a woman. In the same period, in the territory covered by the Police Administration in Prijepolje, 338 emergency measures were issued.
From 1 June last year, 304 cases of family violence were reported in the territory of Prijepolje, Nova Varos and Priboj, of which 145 were reported in the territory of Prijepolje municipality.
“In this period, according to the order of the competent prosecutor’s offices, the police filed criminal charges against 70 suspects, because of the suspicion that they committed the crime of violence. In the same period before the application of the law, from June 2016 to June 2017, 68 persons have been charged with criminal charges for domestic violence, which can be concluded that the number of crimes for this one and year before this law is at the same level.
Also, in the previous year, according to the Law on Prevention of Domestic Violence, 338 emergency measures were issued. I would like to point out that this law also has a preventive function, which is reflected in the new police powers that reveal the imminent danger of domestic violence and which apply when the imminent danger is detected. Therefore, for the implementation of the measures provided for by this law, it is not necessary even that violence have elements of the criminal act occur. The emphasis is on preventing violence from occurring at all”, said Ana Puzovic Gluscevic, coordinator for violence in the family of the Prijepolje Police Directorate.
The police went to the place of violence after each call or application.
“The competent police officers who have passed specialized training for the prevention of domestic violence are obliged to immediately assess the risk of imminent danger at each occurrence of events with elements of domestic violence and, after the risk assessment establishes an imminent threat, they issue an order that gives the perpetrator possible one or both emergency measures. In total, 338 emergency measures were pronounced in this three cities, 179 of them in Prijepolje – 118 of measures of temporary prohibition for the perpetrator to contact the victim of violence, and 61 measures of temporary removal of the perpetrator from the apartment”, Puzovic Gluscevic says.
After receiving the notification, risk assessment and ordering by the competent police officer, in 34 cases, the prosecutor established immediate danger and submitted a proposal to the competent court to extend the urgent measure, which the Basic Courts in Prijepolje and Priboj did.
The police officer said that inter-institutional cooperation is extremely good.
“Protection against domestic violence begins with the identification of violence, which is the legal obligation of all institutions within their regular activities – the obligation of the police, social work centers, health and educational institutions. In our area, a Coordination and Co-operation Group was formed, comprised of representatives of the police, the prosecutor’s office and the Center for Social Work. This group is considering individual cases of domestic violence, assessing risks and adopting individual plans for the protection and support of the victim of domestic violence”, says officer Puzovic Gluscevic.
The Coordination and Cooperation Group meets once a week, and from the Prosecution say that at these meetings, all cases in which a final court verdict has not yet been issued, in order to provide adequate protection and support to victims of violence.
Od početka primene Zakona o suzbijanju nasilja u porodici prošlo je više od godinu dana, a u tom periodu u Osnovnom javnom tužilaštvu u Prijepolju su evidentirana 94 slučaja, od toga u 90 slučajeva se radilo o nasilju nad ženskom osobom. U istom periodu na teritoriji koju pokriva Policijska uprava u Prijepolju izrečeno je 338 hitnih mera.
Od 1. juna prošle godine na teritoriji Prijepolja, Nove Varoši i Priboja prijavljena su 304 slučaja porodičnog nasilja, od tog a 145 na teritoriji opštine Prijepolje.
„Policija je u ovom periodu, po nalogu nadležnih tužilaštava, protiv 70 osumnjičenih podnela krivične prijave, zbog postojanja osnova sumnje da su počinili krivično delo nasilja. U istom periodu pre primene zakona, tj. od juna 2016. do juna 2017, protiv 68 osoba su podnete krivične prijave za nasilje u porodici, na osnovu čega se može zaključiti da je broj krivičnih dela za godinu dana i pre ovog zakona i sada na istom nivou.
Takođe, u prethodnih godinu dana postupajući po Zakonu o sprečavanju nasilja u porodici izrečeno je 338 hitnih mera. Ovde bih istakla da ovaj zakon ima i preventivnu funkciju, koja se ogleda u novim ovlašćenjima policije kojima se otkriva da li preti neposredna opasnost od nasilja u porodici i koja se primenjuju kada je neposredna opasnost otkrivena. Dakle, za primenu mera koje ovaj zakon predviđa, nije nužno čak ni da se dogodilo nasilje koje bi imalo elemente krivičnog dela. Akcenat je na tome da se spreči da do nasilja uopšte dođe“, ističe Ana Puzović Gluščević, koordinatorka za nasilje u porodici Policijske uprave Prijepolje.
Policija je izašla na lice mesta nakon svake prijave.
„Nadležni policijski službenici koji su prošli specijalizovnu obuku za sprečavanje nasilja u porodici, dužni su da kod svake prijave događaja sa elementima nasilja u porodici odmah procene rizik neposredne opasnosti i da, ako posle procene rizika ustanove neposrednu opasnost, donesu naređenje kojim se mogućem učiniocu izriče jedna ili obe hitne mere. Ukupno je izrečeno 338 hitnih mera, od kojih 179 u Prijepolju, i to 118 mera privremene zabrane učiniocu da kontaktira žrtvu nasilja i prilazi joj i 61 mera privremenog udaljenja učinioca iz stana“, kaže Puzović Gluščević.
Posle prijema obaveštenja, procene rizika i naređenja od strane nadležnog policijskog službenika, u 34 slučaja je tužilac ustanovio neposrednu opasnost i nadležnom sudu podneo predlog da se hitna mera produži, što su Osnovni sudovi u Prijepolju i Priboju i učinili.
Iz policije kažu da je međuinstitucionalna saradnja izuzetno dobra.
“Zaštita od nasilja u porodici počinje prepoznavanjem nasilja, a to je zakonska obaveza svih institucija u okviru njihovih redovnih delatnosti – obaveza policije, cenatara za socijalni rad, zdravstvenih i obrazovnih ustanova. Na našem području formirana je Grupa za koordinaciju i saradnju, koju čine predstavnici policije, tužilaštva i centra za socijalni rad. Ova grupa razmatra pojedinačne slučajeve nasilja u porodici, vrši procenu rizika i donosi individualne planove zaštite i podrške žrtvi nasilja u porodici“, kaže oficirka Puzović Gluščević.
Grupa za koordinaciju i saradnju se sastaje jednom nedeljno, a iz Tužilaštva kažu da se na ovim sastancima posebno razmatraju svi slučajevi u kojima još uvek nije doneta pravosnažna sudska presuda, kako bi se pružila adekvatna zaštita i podrška žrtvama nasilja.
