Monitoring the Institutional Response to Gender-Based Violence in Kosovo

The Kosovo Women’s Network launched today a report on monitoring the institutional response to gender-based violence in Kosovo. This report titled “From Words to Acts?” Has shown monitoring findings and legal violations by relevant institutions dealing with domestic violence, as well as recommendations that will impact on improving the handling of cases of this nature. Igballe Rugova from the Women’s Network said there has been progress in institution building, but there is stagnation in practice.
Rugova requested that with the new Criminal Code, domestic violence be considered a crime.
“We no longer want words, we want works, therefore we have also cooperated with BIRN. Together with the Network, BIRN monitored court violations. There we have no frivolity, and this frivolity has brought not only domestic violence, but the abusers have taken the lives of their women to their homes, but also out on the street. It is really time to apply these mechanisms, to the perpetrators who will not easily pass the sentences to the court. That is why we have said that domestic violence is a crime. Criminal Code to be amended and with our request domestic violence to be considered a crime “, Rugova said. Naim Qelaj, Deputy Minister of Justice and National Coordinator on Domestic Violence, said the report in question will serve a lot in the future and will be taken into account in his work. “I am interested and I have asked all relevant institutions to report on the implementation of the international strategy in relation to domestic violence. Thanks to political activism, KW activism and other NGOs, Kosovo has managed to have sustainable legislation. Violence is sanctioned, all involved institutions such as the police, the prosecution and the courts are at the level of duty despite the remarks of the NGOs, which have good intentions. On the other hand , Deputy Chief State Prosecutor, Sevdije Morina, said that soon will be the appointment of specialized prosecutors in this area who will only deal with cases of domestic violence.

Rrjeti i Grave të Kosovës lansoi sot raportin mbi monitorimin e reagimit institucional ndaj dhunës me bazë gjinore në Kosovë. Ky raport i titulluar “Nga Fjalët në Vepra?”, ka treguar për gjetjet e monitorimit dhe shkeljet ligjore nga institucionet përkatëse të cilët trajtojnë dhunën në familje, si dhe rekomandimet të cilat do të ndikojnë në përmirësimin e trajtimit të rasteve të kësaj natyre. Igballe Rugova, nga Rrjeti i Grave tha se ka patur progres në krijimin e institucioneve, por ka ngecje në praktikë.
Rugova kërkoi që me Kodin e Ri Penal, dhuna në familje të cilësohet si krim.
“Ne nuk duam më fjalë, po duam vepra, për këtë arsye edhe kemi bashkëpunuar me BIRN. Së bashku me Rrjetin, BIRN ka monitoruar shkeljet gjyqësore. Aty kemi pa joseriozitet, dhe ky joseriozitet ka sjellë jo vetëm dhunë në familje, por dhunuesit kanë marrë jetën e grave të tyre në shtëpitë e tyre, por edhe jashtë në rrugë. Me të vërtetë është koha që të zbatojmë këto mekanizma, e t`u themi dhunuesve që nuk do të kalojnë lehtë dënimet në gjykatë. Kjo është arsyeja që kemi thënë se dhuna në familje është krim. Kodi Penal të amandamentohet dhe me kërkesën tonë dhuna në familje të konsiderohet si krim”, tha Rugova. Naim Qelaj, zëvendës ministër i Drejtësisë dhe Koordinator Kombëtar mbi Dhunën në Familje, tha se raporti në fjalë do t’i shërbejë shumë në të ardhmen dhe do ta ketë parasysh gjatë punës së tij. “Jam i interesuar dhe kam kërkuar nga të gjitha institucionet relevante në raport me zbatimin e strategjisë ndërkombëtare në raport me dhunën në familje. Falë aktivizmit politik, aktivizmit të RrGk- së dhe OJQ- ve të tjera Kosova ka arritur që të ketë legjislacion të qëndrueshëm. Dhuna sanksionohet, të gjitha institucionet e involvuara si policia, prokuroria dhe gjykata janë në nivel të detyrës pavarësisht vërejtjeve të OJQ- ve, të cilat kanë qëllime të mira. Mua raporti do të më shërbejë në punën time, raporti juaj është specifik, i detajuar, gjithëpërfshirës dhe janë tema të cilat do t`i kem prioritet në të ardhmen dhe shpresoj se do të ndikojë për të mirë”, tha Qelaj.Në anën tjetër, zëvendës kryeprokurorja e shtetit, Sevdije Morina, tha se së shpejti do të bëhet caktimi i prokurorëve të specializuar në këtë fushë, që do të merren vetëm me rastet në dhunën në familje.
