Bosnia and Herzegovina: Council of Ministers Adopted Concluding Comments and Recommendations of the CEDAW Committee/Bosna i Hercegovina: Savjet ministara usvojio zaključna zapažanja i preporuke CEDAW Komiteta
9 July 2020 – The Council of Ministers of the Bosnia and Herzegovina recently adopted the Information on Concluding Comments on 6th Report of the Bosnia and Herzegovina on Implementation of the Convention on Elimination of All Forms of Discrimination against Women for the Period 2013 – 2016, and recommendations for the institutions of the Bosnia and Herzegovina. The Council instructed the BiH Ministry for Human Rights and Refugees to hold consultations with authorized institutions within the period of 90 days.
CEDAW Committee adopted concluding comments and recommendations upon its 74th session held in October 2019, and also consulted the alternative report, additional submissions, and held consultations with women representatives of the civil society organizations from the Bosnia and Herzegovina, which directly participated in the CEDAW Committee session in Geneva, including United Women Foundation from Banja Luka, Rights for All Sarajevo, Helsinki Citizens Assembly Banja Luka, CURE Foundation from Sarajevo, Women Citizens for Constitutional Changes, Sarajevo Open Centre and TRIAL in Bosnia and Herzegovina.
The Information emphasizes the fact that CEDAW represents integral part of the Constitution of Bosnia and Herzegovina, and emphasizes the key obligations of BiH institutions, as follows:
– To integrate, without delay, the definition of discrimination against women in the Constitution of BiH, in line with the Article 1 of the Convention,
– To adopt, without delay, revised National Strategy for Processing War Crimes until 2023, with the objective to speed up the in order to speed up the prosecution of crimes of sexual violence during the war, and to establish a fund to provide compensations and other forms of reparations for women victims of war crimes,
– To increase awareness of political leaders and general public about the nature of special temporary measures and importance of reaching real equality of women and men in all areas in which women are under-represented or are in unfavorable position,
– To prepare comprehensive strategy for eliminating discriminatory gender stereotypes related to roles and responsibilities of women and men in a family and society, harmonize relevant legislation with the recommendations of the Council of Europe on Prevention and Combating Sexisms, and establish the mechanism for monitoring use of sexist and misogynic language and hate speech in public discourse, and sexist portrayals of women in media,
– To establish efficient mechanisms of protection for women politicians, journalists, human rights defenders and women’s nongovernmental organizations in order to enable them to freely conduct important work without fear or threats of violence and harassment,
– To increase protection of victims of gender based violence, and establish the joint system of data collection on all forms of gender based violence in the country,
– To commit to the solving of key causes of trafficking of people through improving educational and economic opportunities for women, girls, and their families, especially within Roma community, which would decrease their exposure to exploitation by human traffickers,
– To adopt changes and amendments of the Election Law of the Bosnia and Herzegovina for increase of quota for women candidates on the election lists of political parties to 50 percent, and the Law on the Council of Ministers of Bosnia and Herzegovina for introducing of minimum quota of 40 percent of less represented sex in the Council of Ministers of Bosnia and Herzegovina,
– To encourage diversification of choice of education for girls, and to, without further delay, integrate education about sexual and reproductive health and rights into school programs, and adjust it to the age of children,
– To increase availability and quality of education for all children, and solve unequally law rate of enrollment and completion of education at all levels of education among girls from Roma families,
– To harmonize regulations on maternity leave payments and ensure equal payments for mothers, and payments during maternity leave in all parts of the country,
– To adopt the National Strategy for Women with Invalidity and ensure meaningful participation of the association of women with invalidity in all phases of its development and implementation,
– To ensure respect of human rights of lesbians, bisexual and transgender women, and ensure that national action plans include topics of stigma and discrimination against them in all spheres of life.
08. juli 2020. godine – Savjet ministara Bosne i Hercegovine je nedavno usvojio Informaciju o zaključnim zapažanjima na 6. izvještaj Bosne i Hercegovine o implementaciji Konvencije o uklanjanju svih oblika diskriminacije žena za period 2013 – 2016. godine i preporuke za institucije Bosne i Hercegovine. Savjet ministara BIH je zadužio Ministarstvo za ljudska prava i izbjeglice BiH da u roku 90 dana, sa nadležnim institucijama BiH obavi konsultacije.
CEDAW Komitet je zaključne komentare i preporuke usvojio nakon 74. zasjedanja održanog u oktobru 2019. godine, konsultujući istovremeno i alternativni izvještaj, dodatne podneske i konsultacije sa predstavnicama organizacija civilnog društva iz Bosne i Hercegovine koje su direktno pratile sjednicu održanu u Ženevi, uključujući Fondaciju Udružene žene iz Banja Luke, Prava za Sve Sarajevo, Helsinški parlament građana Banja Luka, Fondaciju CURE Sarajevo, Sarajevski Otvoreni Centar i TRIAL u Bosni i Hercegovini.
Informacija naglašava činjenicu da je CEDAW Konvencija sastavni dio Ustava Bosne i Hercegovine, i ističe ključne obaveze koje Bosna i Hercegovina mora ispuniti, kako slijedi:
– Da bez odlaganja u Ustav BIH ugradi definiciju diskriminacije žena, na način kako je to definisano članom 1. Konvencije,
– Da bez odlaganja usvoji revidiranu Nacionalnu strategiju za procesuiranje ratnih zločina do 2023. godine, u cilju ubrzavanja procesuiranja zločina seksualnog nasilja tokom rata, i uspostavi fond za osiguravanje naknada i drugih oblika odštete za žene žrtve ratnih zločina,
– Da podigne svijest političkih lidera i šire javnosti o prirodi posebnih privremenih mjera i važnosti postizanja stvarne ravnopravnosti žena i muškaraca u svim oblastima u kojima su žene nedovoljno zastupljene ili se nalaze u nepovoljnom položaju,
– Izradi sveobuhvatnu strategiju za ukidanje diskriminatornih rodnih stereotipa koji se odnose na uloge i odgovornosti žena i muškaraca u porodici i društvu, prilagodi odgovarajuće zakonodavstvo u skladu s preporukom Vijeća Evrope o sprječavanju i suzbijanju seksizma i uspostavi mehanizam za praćenje upotrebe seksističkog i mizoginističnog jezika i govora mržnje u javnom diskursu i seksističkim prikazima žena u medijima,
– Da usvoji djelotvorne mjere zaštite političarki, novinarki, braniteljki ljudskih prava i ženskih nevladinih organizacija kako bi im se omogućilo da slobodno izvršavaju svoje važne poslove bez straha ili prijetnje nasiljem ili uznemiravanjem,
– Da pojača zaštitu žrtava rodno zasnovanog nasilja i uspostavi jedinstven sistem prikupljanja podataka o svim oblicima rodno zasnovanog nasilja u državi,
– Da se posveti rješavanju ključnih uzroka trgovine ljudima unapređenjem obrazovnih i ekonomskih prilika za žene, djevojke/čice i njihove porodice, posebno među romskom zajednicom, čime bi se umanjila njihova izloženost iskorištavanju od strane trgovaca ljudima,
– Da usvoji izmjene i dopune Izbornog zakona Bosne i Hercegovine za povećanje kvote za kandidatkinje na izbornim listama političkih stranaka na 50 posto i Zakona o Vijeću ministara Bosne i Hercegovine za uvođenje minimalne kvote od 40 posto manje zastupljenog spola u Vijeću ministara BIH,
– Da podstiče diversifikaciju izbora obrazovanja za djevojčice i da bez daljnjeg odgađanja, uvrsti obrazovanje prilagođeno dobi djece o seksualnom i reproduktivnom zdravlju i pravima u školskim programima,
– Da poveća dostupnost i kvalitet obrazovanja za svu djecu i riješi nerazmjerno nisku stopu upisa i završetka školovanja na svim nivoima obrazovanja među djevojčicama iz romskih porodica,
– Uskladi propise o porodiljskim naknadama i osigura jednake naknade za majke i naknade za vrijeme porodiljskog odsustva u svim dijelovima države,
– Usvoji nacionalnu strategiju za žene s invaliditetom i osigura smisleno učešće organizacija žena s invaliditetom u svim fazama njenog razvoja i primjene,
– Osigura poštivanje ljudskih prava lezbejki, biseksualnih i transrodnih žena i osigura da se u nacionalnim akcionim planovima za ravnopravnost spolova obradi tema stigme i diskriminacije protiv njih u svim sferama života.
